Prescribed Punishments الحدود

  • (4482)  عن أبي بردة  أَنَّ رَسُولَ  صلى الله عليه وسلم  كان يقول (( لا يُجْلَدُ فَوْقَ عَشْرِ جَلَدَاتٍ إِلَّا فِي حَدٍّ مِنْ حُدُودِ الله  عزَّ وَجَلَّ ))

( سنن أبي داود )

Abu Burdah reported the Messenger of Allah (peace be upon him) as saying

No more than ten lashes are to be given, except in the case of one of the punishment prescribed by Allah, the Exalted

  • (1423) عَنْ عَلِيِّ رضي الله عنه : أَنَّ رَسُولَ الله صلى الله عليه وسلم قَالَ : (( رُفِعَ القَلَمُ عَنْ ثَلاثَةٍ : عَنِ  النَّائِمِ حَتَّى يَسْتَيْقِظَ  ؛ وَعَنِ الصَّبَيِّ حَتَّى يَشِبَّ ؛ وَعَنِ المَعْتُوهِ حَتَّى يَعْقِلَ ))

( جامع الترمذي )

Narrated ‘Ali

That the Messenger of Allah (peace be upon him) said: “The pen has been lifted from three; for the sleeping person until he awakens, for the boy until he becomes a young man and for the mentally insane until he regains sanity.”

  • (1424)  عَنْ عَائِشَةَ رضي الله عنها  قَالَتْ : : قَالَ رَسُولُ اللهِ صلى الله عليه وسلم  (( ادْرَؤُوا الحُدُودَ  عَنِ المُسْلِمِينَ مَا اسْتَطَعْتُمْ ؛ فَإِنْ كَانَ لَهُ مَخْرَجٌ  فَخَلُّوا سَبِيلَهُ ؛ فَإِنَّ الإمَامَ  إِنْ يُخْطِىءَ فِي العَفْوِ خَيْرٌ مِنْ أَنْ يُخْطِىءَ فِي العُقُوبَةِ ))

Narrated ‘Aishah

that the Messenger of Allah (peace be upon him): “Avert the legal penalties from the Muslims as much as possible, if he has a way out then leave him to his way, for if the Imam makes a mistake in forgiving it would be better than making mistake in punishment.”

  • (1460 )  عَنْ جُنْدُبٍ رضي الله عنه  قَالَ : قَالَ رَسُولُ الله صلى الله عليه وسلم :  (( حَدُّ السَّاحِرِ ضَرْبَةٌ بِالسَّيْفِ ))

Narrated Jundab

That he heard the Messenger of Allah (peace be upon him) saying: “The punishment of the Sahir is a strike of the sword.”

  • (5676) عَنْ سَعِيدِ بْنِ المُسَيِّبْ  قَالَ : غَرَّبَ عُمَرُ رضي الله عنه  رَبِيعَةَ بْنَ أُمَيَّةَ فِي الخَمْرِ إِلَى خَيْبَرَ فَلَحِقَ بِهَرِقْلَ فَتَنَصَّرَ فَقَالَ عُمَرُ رضي الله عنه : لا أُغَرِّبُ بَعْدَهُ مُسْلِمًا

It was narrated that Sa’eed bin Al-Musayyab said

“‘Umar, may Allah be pleased with him, banished Rabi’ah bin Umaiyah to Khaibar for drinking Khamr, and he went and joined Heraclius and became a Christian. ‘Umar, may Allah be pleased with him, said: ‘I will never expel any Muslim after this.'”
